On 12/24/14 at 3:00 am, Investigators with the Johnson City Police Department responded to a shooting at 883 W Main St #104. The victim suffered a gunshot wound to his right foot. The investigation revealed that his neighbor John Upshaw (883 W Main St #204, 43 yrs old ) accidentally shot him. Both parties admitted they were drinking and reminiscing about their time in the military when Mr. Upshaw started handling a Smith and Wesson SD40 40 cal. Pistol owned by the victim. Mr. Upshaw was inquiring about purchasing the pistol when it went off, striking the victim in the right foot. The victim was transported to the Johnson City Medical Center for treatment of his injuries. John Upshaw was charged with Reckless Endangerment and is being held in the Washington County Detention Center in lieu of a $10,000 bond. He is scheduled for Arraignment in General Sessions Court on 12/29/14 at 1:30 pm.
